  1. ESTABLISHMENT IDENTIFICATION

These General Terms and Conditions govern the booking of tourist accommodation services offered by:

Booking any service implies full acceptance of these terms and conditions.

  1. PURPOSE OF THE CONTRACT

The purpose of this contract is the provision of tourist accommodation services and, where applicable, any additional services booked by the guest during the reservation process.

  1. BOOKING PROCESS

The booking will be confirmed when:

      • The guest completes the booking process.
      • The establishment confirms the reservation by email.
      • The required payment or guarantee has been made according to the selected rate.

The reservation holder declares:

      • To be over 18 years of age.
      • To have legal capacity to enter into contracts.
      • That the information provided is accurate and truthful.
  1. PRICES

All prices shown include the applicable VAT.

Prices may vary depending on:

      • Stay dates.
      • Occupancy.
      • Advance booking.
      • Current promotions.

Additional services booked subsequently will be invoiced separately.

  1. PAYMENT CONDITIONS

Payment conditions will depend on the rate booked. Rates booked through the direct channel are exclusive to the hotel and may offer advantages over external booking channels.

Prepaid rates

The establishment may send a payment link to the email address provided by the guest.

If payment is not made within the deadline set for the booked rate, the reservation may be automatically cancelled.

Non-refundable rates

The full amount will be charged at the time indicated during the booking process.

No refunds or modifications will be accepted unless required by mandatory law.

BeSafe Rates

The total amount of the reservation will be charged in full at the time indicated during the booking process.

BeSafe Rates include a travel insurance policy provided by an external insurance company. Once the reservation is confirmed, the guest will receive directly at the email address provided the policy documentation, its coverage conditions and the procedure for managing incidents, cancellations or refund requests covered by the insurance.

Hostal Moscatel acts solely as an intermediary in the marketing of this rate and assumes no responsibility for the coverage, exclusions, compensation, acceptance or rejection of claims, nor for any decision made by the insurance company.

Any query, claim, management or request related to the policy must be made directly with the insurer, in accordance with the particular and general conditions of the insurance contracted.

Group Bookings are not accepted.

A group booking is defined as any reservation including two or more rooms, regardless of whether the reservations were made in one or several linked transactions.

To confirm a group booking, the establishment may require advance payment of 50% of the total stay amount.

This amount will be treated as a non-refundable deposit and will not be returned in the event of total or partial cancellation by the guest.

The remaining 50% must be paid within the deadlines and conditions communicated by the establishment in the booking confirmation.

Failure to pay any of the required amounts may result in the cancellation of the reservation by the establishment.

  1. CANCELLATIONS AND MODIFICATIONS

The cancellation and modification conditions will be those expressly accepted by the guest during the booking process.

Each rate may establish:

      • Free cancellation up to a specific date.
      • Partial penalties.
      • A penalty of 100% of the reserved amount.
      • Non-refundable condition.

Non-arrival (“No Show”) will be considered a late cancellation and will result in the penalty applicable to the booked rate and the cancellation of the reservation.

BOOKINGS MADE THROUGH INTERMEDIARIES

Bookings made through travel agencies, online travel agencies (OTAs), tour operators, booking centres or any other commercial intermediary will be subject to the particular conditions established by that intermediary.

Any request for modification, cancellation, refund, date change, invoicing or claim related to the reservation must be managed directly with the channel through which the booking was made. Hostal Moscatel cannot unilaterally modify the conditions agreed between the guest and the intermediary.

Hostal Moscatel may provide information about the stay and assist the guest during their accommodation, but will not assume responsibility for commercial conditions, cancellation policies, charges, refunds or commitments made by third parties.

Bookings made directly with Hostal Moscatel, whether through the official website, telephone, email or proprietary sales channels, may benefit from exclusive conditions, promotions, discounts, additional services and advantages that will not necessarily be available for bookings made through intermediaries.

  1. RIGHT OF WITHDRAWAL

In accordance with Article 103.l of Royal Legislative Decree 1/2007, the right of withdrawal shall not apply to accommodation services for specific dates or periods.

  1. TRAVELLER REGISTRATION AND MINORS.

All guests must identify themselves and provide the information required by current regulations.

The establishment may require online check-in to be completed prior to arrival.

Failure to comply with legal identification obligations may prevent access to the accommodation.

Minors may only stay at the establishment when accompanied throughout their entire stay by their duly accredited father, mother or legal guardian. Reservations or stays by minors travelling alone or accompanied by adults who are not legally their father, mother or legal guardian will not be accepted.

Detection of any of these circumstances will entitle the establishment to immediately cancel the reservation and deny access to the accommodation, with no right to a refund of amounts paid, as this constitutes a breach of an essential booking condition accepted by the guest during the reservation process.

  1. SCHEDULES

Check-in

From 14:00.

Check-out

Until 11:30.

Early check-ins and late check-outs are subject to availability and may incur additional charges.

  1. ARRIVALS OUTSIDE STAFFED HOURS

Arrivals outside reception hours will require:

      • Online check-in to have been completed.
      • Applicable payment conditions to have been met.
      • A valid email address and active phone number to have been provided.

Access instructions will be sent by email or electronic messaging only to the contact details provided at the time of booking. If you need to update them, please do so through the booking platform.

The establishment does not guarantee access when these requirements have not been met.

  1. ROOM OCCUPANCY

Only persons included in the reservation and registered in accordance with current legislation may stay in the room.

The following are prohibited:

      • Exceeding the authorised maximum capacity.
      • Allowing access or overnight stay by unregistered persons.

Non-compliance may result in the immediate termination of the contract.

  1. PETS

Pets will only be permitted when:

      • The rate or reservation expressly includes them.
      • They have been communicated in advance.
      • The corresponding supplements have been paid.
      • There is a Pet Policy available at https://www.hostalmoscatel.com/en/pets/
      • Only one pet per room is permitted, except in superior rooms.

The owner will be responsible for any damage, mess or disturbance caused by the animal.

  1. HOUSE RULES

Guests must respect the rest and tranquillity of other guests.

The following are expressly prohibited:

      • Holding parties.
      • Using speakers or sound equipment.
      • Playing music at a volume that may disturb other guests.
      • Carrying out activities contrary to current regulations.
      • Smoking in the accommodation.
  1. NO SMOKING POLICY

Smoking is prohibited in:

      • Rooms.
      • Bathrooms.
      • Indoor common areas.
      • Windows, balconies or spaces where smoke may affect other guests.

Non-compliance may result in the immediate termination of the accommodation contract.

  1. LIABILITY FOR DAMAGES

The guest will be financially responsible for:

      • Damage caused in rooms.
      • Furniture.
      • Equipment.
      • Decorative elements.
      • Common installations.

The establishment may claim the costs of repair or replacement.

  1. PERSONAL BELONGINGS

The establishment will not be responsible for any valuables belonging to guests found in rooms or common areas, such as:

      • Cash.
      • Jewellery.
      • Electronic equipment.
      • Documents.
      • Personal belongings, etc.
  1. THIRD-PARTY SERVICES

The establishment may act solely as an intermediary for certain additional services.

Including, among others:

      • Taxi.
      • Vehicle rental.
      • Excursions.
      • Tourist activities.

The booking of services provided by third parties, including but not limited to taxi, transport, vehicle rental, excursions or tourist activities, will be subject to the availability and conditions of the respective providers.

Hostal Moscatel acts solely as an intermediary in managing such requests and does not guarantee the effective provision of these services. In the event of cancellation, unavailability, delay, strike, operational incident or impossibility of provision by the external provider, the establishment will assume no liability and will not be obliged to pay compensation, indemnities or additional amounts to the guest.

  1. FORCE MAJEURE

The establishment will not be liable for non-performance resulting from circumstances beyond its control, including:

      • Meteorological events.
      • Strikes.
      • Administrative restrictions.
      • Supply outages.
      • Emergency situations.
      • Force majeure or unforeseen circumstances.
  1. RIGHT OF ADMISSION AND TERMINATION OF CONTRACT

The establishment may immediately terminate the accommodation contract and require the guest to leave the premises when the guest:

      • Provides false information.
      • Fails to comply with house rules.
      • Causes serious disturbance to other guests.
      • Accommodates unregistered persons.
      • Causes damage to the facilities.
      • Fails to comply with the Internal Rules and Regulations.
      • Engages in conduct contrary to current legislation.

In these cases, there will be no right to a refund of amounts paid.

  1. APPLICABLE LAW AND JURISDICTION

These conditions shall be governed by Spanish law.

The parties submit to the Courts and Tribunals of Málaga, unless a mandatory rule provides otherwise.

In compliance with the General Data Protection Regulation and the Law on Information Society Services and Electronic Commerce, we inform you that Hostal Moscatel Salitre Málaga, S.L. is responsible for the personal data that may be contained in this email and its attachments. The purpose is the management of institutional, administrative or service relations between the parties. The legitimate basis for sending it is legitimate interest and the contractual or pre-contractual relationship.
